These terms apply to all engagements that Shehe Atlas Financial Consulting (sole proprietorship, trading as «Steuererklärung Winterthur») carries out for clients, unless otherwise agreed in writing.
This is a translation for convenience; the German version is legally binding.
1. Scope and conclusion of contract
The contract is concluded as soon as we accept a request and begin work on it. A request submitted via the form is not yet a contract but a request for a quote. Swiss law applies; the provisions on simple agency contracts under Art. 394 et seq. of the Swiss Code of Obligations (OR) are applicable.
2. Scope of services
We prepare the tax return on the basis of the documents and information you provide, check the applicable deductions and, once you have approved it, file the return electronically with the competent authority. Additional services — in particular objections, filing extensions, bookkeeping and advice — are agreed separately and billed according to time spent.
Checking the documents you provide for factual accuracy is not part of the engagement. We assume that the documents submitted are genuine and complete.
3. Duty to cooperate
You provide the necessary documents completely, legibly and in good time. You inform us of any changes relevant to the tax return — in particular marriage, separation, birth, moving house, a change of job, inheritance, purchase of property or retirement.
Delays caused by incomplete or late documents are your responsibility. The same applies to deadlines that cannot be met as a result.
4. Approval and filing
Before filing, you receive the complete tax return to review. By approving it, you confirm that the information reflects your situation. By law, responsibility for the accuracy and completeness of the tax return lies with the taxpayer.
5. Fees and payment
The rates published on our Pricing page apply. We inform you of surcharges for exceptional effort before carrying out the work and only proceed with your agreement. Invoices are payable within 30 days of the invoice date without deduction. In the event of late payment, reminder fees and statutory default interest are charged.
6. Deadlines
We point out running deadlines and apply for filing extensions on request. Meeting statutory deadlines requires that we receive the documents in good time — as a guideline, at least four weeks before the deadline expires. We accept no liability for missed deadlines caused by late delivery of documents.
7. Liability
We are liable for damage caused intentionally or through gross negligence. Liability for slight negligence is excluded to the extent permitted by law. We do not reimburse tax amounts that would have been owed even with a correct tax return, nor consequential damage resulting from incomplete or incorrect information provided by the client.
8. Confidentiality and data protection
We treat all information from the engagement confidentially. The processing of personal data is governed by our privacy policy. We keep documents for the statutory retention periods.
9. Termination
Either party may end the engagement at any time. Services already rendered are billed according to time spent. On request, we return your original documents.
10. Place of jurisdiction
The place of jurisdiction is Winterthur, unless mandatory statutory provisions stipulate a different place of jurisdiction.
